Summary Explanation/Background:

Bid E-47-18 was issued to obtain bids from construction firms for furnishing all labor, equipment, tools, and materials necessary for remediation service in the Sports Complex area.  Bid award is recommended to the lowest responsive responsible bidder, Terracon Consultants., Inc., at a cost of $896,724.00.

The project is located on NW 31st Avenue just north of Atlantic Boulevard. The 12-acre parcel is planned to become a Sports Complex facility, a project that’s being developed by Azur. In order to make this site suitable for its intended purpose, remediation is necessary. An environmental analysis of the entire site was conducted by Cardno, Inc. acting on behalf of the City, which revealed contamination in various locations throughout the site. The contamination is due to pesticides and fertilizers used while the existing park was used as a golf course facility. The Florida Department of Environmental Protection (FDEP), Environmental Protection Agency (EPA), Broward County Health, among others, will not allow the site to be redeveloped without remediation to minimum acceptable levels suitable for children. The funds to conduct remediation were identified and earmarked in the General Funds. As a function of designating the site as a Brownfield, which the City Commission approved via Resolution 2018-34 on October 24, 2017, the City is allowed to clean-up the site and subsequently apply for tax credits. Subject to State approval, the City may be entitled to receive up to 75% of the anticipated expenses (approximately $670k). Tax credits are available on a first come-first serve basis. Therefore, the City’s ability to recover monies will be subject to timely submittals and funding availability. Staff anticipates to complete the project in time to submit for eligibility in 2019, which would result in funding being available to the City in 2021. However, the State may not process our application until later in the year or another government agency may claim eligibility ahead of us. In that case, the City can expect the monies in 2022.

The General Services Department performed outreach to local excavation companies to inform them about this project.  A total of thirty (30) local companies were notified.  This solicitation was assigned a 15% Local Business participation goal; the recommended bidder has indicated 15% Local Business participation.  City Commission approval of this contract award is requested.
