Summary:
The Applicant Landowner is requesting a Major Temporary Use Permit from the provisions of Chapter 155, Article 4 [Use Standards] and Article 5 [Development Standards] of the City’s Zoning Code, in order to temporarily utilize a parcel for a sales center with associated parking and landscaping without full compliance with the applicable use and development standards of the Code.
The property is located on a 20-acre parcel within the overall 221.60-acre master planned development project (LIVE! Pompano) bounded by Loop Road to the east and south, Main Street to the west, and a 12-acre lake to the north.
PROPERTY INFORMATION
1. The subject property is part of the overall 221.60-acre LIVE! Pompano master planned development and contains approximately 20 acres. The property has zoning entitlements for seven six-story multi-family buildings and nine two-story townhome-style buildings, providing 344 multi-family dwelling units and 82 fee-simple townhomes, approved by the Planning & Zoning Board via PZ #24-12000022 on July 23, 2025.
2. The Applicant is requesting approval to temporarily utilize a portion of the site for a sales center consisting of an approximately 2,500-square-foot structure, 10 parking spaces, and associated landscaping. A temporary retention area is also proposed to serve the sales center.
3. The Applicant states that the sales center will be used for pre-sales and project-related activities during the review, permitting, and construction phases of the approved development and is expected to remain on site only for the duration of construction.
4. The proposed sales center is located within an area approved for multi-family residential development. The Applicant states that the temporary use is intended to support the development and marketing of the approved project and will operate during normal business hours, approximately 9:00 AM to 6:00 PM.
5. The proposed temporary use is located on a portion of the site with sufficient area to accommodate the sales center, associated parking, internal circulation, and temporary retention area. The Applicant states that the proposed temporary improvements will not impact environmentally sensitive lands.
6. Approval of this Temporary Use Permit would authorize only the temporary sales center and associated improvements described in this application and would not constitute approval of the underlying development or waive compliance with any other applicable provisions of the Pompano Beach Zoning Code, the Florida Building Code, or other applicable regulations.

TEMPORARY USE PERMIT REVIEW STANDARDS
Temporary Use Permit shall be approved only on a finding that the temporary use as proposed:
1. Is on its face temporary in nature;
2. Is in harmony with the spirit and intent of this Code;
3. Is not detrimental to property or improvements in the surrounding area, or to the public health, safety, or general welfare;
4. Does not have substantial adverse effects or noise impacts on any adjoining permanent uses or nearby residential neighborhoods;
5. Is compatible with any principal uses on the site;
6. Is located on a site containing sufficient land area to allow the temporary use and associated structures, and accommodate any associated parking and traffic movement, without disturbing environmentally sensitive lands; and
7. Complies with all applicable use-specific standards in Section 155.4403.
Staff Conditions:
Should the Board determine the applicant has provided competent substantial evidence sufficient to satisfy the seven Major Temporary Use Permit review standards, staff requests the Board include the following conditions as part of the Order:
1. Obtain all necessary governmental approvals, including building, tree, and zoning compliance permits.
2. Development shall be in substantial compliance with conceptual site plan submitted with this application.
3. Provide hedges and associated landscaping around the sales center and parking area, subject to approval by the city’s Urban Forester.
4. If permits for the associated development are not obtained prior to expiration of this Temporary Use Permit, the Applicant shall apply for a new Temporary Use Permit or remove the sales center and restore the affect area with drought-resistant sod.
