Summary:
The Applicant Landowner is requesting a Major Temporary Use Permit from the provisions of Chapter 155, Article 4 [Use Standards] and Article 5 [Development Standards] of the City’s Zoning Code, in order to temporarily place three clothing collection bins on the subject property without full compliance with the applicable use and development standards of the Code.
The property is a retail shopping center, located on the west side of South Federal Highway, approximately 1,000 feet north of East McNab Road.

2. Definition
A recycling drop-off station is a small unmanned structure where the collection of materials for recycling or reuse are accepted from the public. Typical uses associated with a drop-off center are temporary storage of donated materials and charitable goods.
3. Standards
A recycling drop-off station is allowed as an accessory use or structure to any principal use or structure, subject to the following standards:
a. The station shall be located in or adjacent to an off-street parking area.
b. The station shall be at least 10 feet from any property line and 25 feet from any property line abutting a street.
c. The station shall be located as close as possible to the principal structure and may be permitted in front of the principal structure.
d. The station shall be located in the area designated for the station as depicted on the approved site plan, per subsection g below.
e. The station shall be screened in accordance with Section 155.5301.C, Location and Screening of Commercial Containers.
f. The station and adjacent area shall be kept free of litter, debris, and residue and be maintained in good appearance.
g. The station must legibly display the name and current address of the owner of the station, along with a valid 24-hour telephone contact number of the owner or its designated representative.
h. Prior to installation of the station a development order for a Minor Site Plan, which depicts the designated location of the station, shall be obtained by the owner of the station, or the property owner where the station will be situated.
i. Prior to installation of the station a building permit for the station must be obtained from the City's Building Department by the owner of the station, or the property owner where the station will be situated. All final approvals for the building permit shall be obtained.
PROPERTY INFORMATION AND STAFF ANALYSIS
1. The subject property, commonly referred to as Pompano Marketplace, is a 238,000-square-foot shopping center anchored by a Walmart Neighborhood Market and located within the General Business (B-3) zoning district.
2. The Applicant, Green Hub, is requesting approval to temporarily place three (3) unattended clothing collection bins on the subject property for a period not to exceed one (1) year. According to the Applicant, the bins are enclosed, require no utility connections or site alterations, and will be serviced on a scheduled weekly basis. The Applicant has also indicated that it has partnered with the City’s Housing and Community Services Department in support of the City’s homeless services program and works with Changing Lives of Boca Raton, Inc., a Florida 501(c)(3) organization supporting individuals experiencing homelessness.
3. A recycling drop-off station is a permitted accessory use in the B-3 zoning district; however, Section 155.4303.AA.3.h requires the station to obtain a Development Order for a Minor Site Plan prior to installation. The Applicant is instead requesting a Major Temporary Use Permit to allow the proposed bins for a limited period not to exceed one (1) year.
4. The proposed bins would be located within an existing paved parking area that the Applicant states operates below capacity. The three (3) bins would occupy approximately 48 square feet and would not require additional parking, site improvements, utility connections, or disturbance of environmentally sensitive lands. The proposed use would be accessory and subordinate to the existing shopping center use.
5. Given the limited duration, small footprint, location within an existing developed commercial property, and proposed maintenance and servicing of the bins, staff finds that the proposed temporary use can be accommodated on the subject property without significant alteration to the site or apparent adverse impacts to surrounding properties or the existing principal use.

TEMPORARY USE PERMIT REVIEW STANDARDS
Temporary Use Permit shall be approved only on a finding that the temporary use as proposed:
1. Is on its face temporary in nature;
2. Is in harmony with the spirit and intent of this Code;
3. Is not detrimental to property or improvements in the surrounding area, or to the public health, safety, or general welfare;
4. Does not have substantial adverse effects or noise impacts on any adjoining permanent uses or nearby residential neighborhoods;
5. Is compatible with any principal uses on the site;
6. Is located on a site containing sufficient land area to allow the temporary use and associated structures, and accommodate any associated parking and traffic movement, without disturbing environmentally sensitive lands; and
7. Complies with all applicable use-specific standards in Section 155.4403.
Staff Conditions:
Should the Board determine the applicant has provided competent substantial evidence sufficient to satisfy the seven Major Temporary Use Permit review standards, staff requests the Board include the following conditions as part of the Order:
1. Obtain all necessary governmental approvals, including building and zoning compliance permits.
2. The three clothing collection bins shall be maintained in good condition and the area surrounding the bins shall be kept free of litter, debris, and deposited materials.
3. The Applicant shall maintain a valid 24-hour telephone contact number on each collection bin for reporting maintenance or other concerns.
4. Upon expiration or termination of the Major Temporary Use Permit, all clothing collection bins shall be removed from the property.
