Summary Explanation/Background:
This is the second reading of the Hidden Harbour LUPA application previously approved on first reading at the January 10, 2017 City Commission meeting. The associated County Land Use Plan amendment was approved by the Broward County Commission on May 22, 2018. The Applicant is proposing a change in the land use designation of the 8.9 gross-acre property located north of NE 14th Street, south of NE 17th Street on the east side of Federal Hwy. The property currently has Commercial (C), Medium High (MH) and Low Medium (LM) Future Land Use designations. The property straddles the base of a canal and currently includes a marina, a boat yard and vacant property. The Applicant is requesting a change in land use to Mixed Use Residential - High (MUR-H). In this small scale land use plan amendment the Applicant is proposing a maximum of 323 Dwelling Units and a maximum of 650,000 total square feet for all uses (residential and nonresidential). The Applicant has provided a Declaration of Restrictions further defining the allowed development. To accommodate a comment from the Planning and Zoning Board, the applicant included in the Declaration the following: “At least 10,000 sq. ft. of commercial space will be vertically integrated with multi-family residential uses in the mixed-use development plan for the property.” The Declaration also includes other restrictions concerning design guidelines for compatibility with adjacent properties and pedestrian access to the waterway. Broward County required additional stipulations which have been added. The Planning & Zoning Board unanimously recommended approval of this amendment on May 25, 2016, with four conditions, which have been met or are being met through the Ordinance’s Exhibit B: Condition of Implementation and Exhibit C: Declaration of Restrictions.
The County is requiring the City enter into an interlocal agreement to provide hurricane evacuation shelter staff as a condition of approval for the County's Land Use Plan amendment for this project. The resolution for that agreement is a companion item on this Commission agenda.
