Summary:                     

The applicant is requesting Building Design approval to construct a two-story marine-use building comprised of offices, a showroom, repair facilities, along with 25 parking spaces with 2 electric vehicle charging spaces. The footprint of the proposed building is 37,810 sq. ft. on a 74,656-square-foot net-area lot (1.71 acres).  Lot coverage is 50.10%.  The Site Plan was reviewed by the Development Review Committee on December 3, 2025; March 18, 2026; July 15, 2026; and in a Post-DRC Submittal dated August 5, 2026. The Planning and Zoning Board is scheduled to review the project at its October 18, 2026, hearing.

 

The property is located on the west side of South Federal Highway, approximately 800 feet south of SE 5 Court.

 

The applicant is required to obtain Variance approval for the following three issues identified during the DRC review:

 

                     The proposed site plan does not provide the perimeter landscape buffer as required.  The buffer is partially provided along the west side of the parcel, and at the north and south property lines, with some reductions due to walkways.  On the other hand, for Commercial Boat and Marine Uses (Section 155.4215), the Code requires the provision of a Type B buffer along all perimeter of the site in accordance with Section 155.5203.F, Perimeter Buffers.

                     The proposed use combination requires 96 parking spaces; however, the proposed site plan provides only 25 parking spaces, including one ADA space and two electric vehicle charging spaces.

                     The use of some parking spaces to provide access to the building eliminates the required curbing in such parking areas.

 

Pursuant to Section 155.2205, Code of Ordinances, the Architectural Appearance Committee may require such changes in plans and specifications as, in its judgment, may be requisite and appropriate to ensure that the exterior appearance of buildings and structures enhances the aesthetic character of the surrounding development by complying with the architectural appearance standards of this Code and approved design guidelines.

The property zone designation is Marine Business (M-1).

Staff Conditions:

 

If approved by the Architectural Appearance Committee, staff recommends including the following conditions:

 

1.                     Obtain a Variance for relief from the following Code requirements:

                     Section 155.4215.A.1 for Standards Applicable to Boat and Marine Sales, Service, and Storage Uses, where if service, repair, installation, and/or maintenance is performed outside of a fully enclosed structure, a type B perimeter buffer shall be provided along all perimeters of the site except where a type C perimeter buffer is required by Section 155.5203.F <https://codelibrary.amlegal.com/codes/pompanobeach/latest/pompanofl_zone/0-0-0-38742>, Perimeter Buffers;

                     Section 155.5102.D.1 for the minimum number of off-street parking spaces, where new development shall provide the minimum number of off-street parking spaces in accordance with Table 155.5102.D.1 <https://codelibrary.amlegal.com/codes/pompanobeach/latest/pompanofl_zone/0-0-0-38420>, Minimum Number of Off-Street Parking Spaces, based on the principal use(s) involved and the extent of development; and

                     Section 155.5102.C.9 for curbing, where each off-street parking space shall include a continuous curb.

2.                     Standard Conditions of approval and/or specifications required prior to Building Permit/Zoning Compliance Permit issuance:

a.                     Pursuant to Section 155.5509, in all new development, all overhead utilities located on the development site and/or along the public right-of-way fronting the development site must be placed underground to the maximum extent practicable, provided that the Development Services Director can waive this requirement where the relevant utility company demonstrates that undergrounding will be detrimental to the overall safety and/or reliability of the circuit.

b.                     Plans are subject to compliance with all applicable Code requirements, including but not limited to DRC comments issued for this site plan.

c.                     A copy of the CPTED plan, approved by the Broward Sheriff’s Office, must be submitted for Zoning Compliance Permit Approval.

d.                     Landscape and Irrigation plans must comply with Zoning Code requirements as verified by the City’s Urban Forestry Division.
