City Commission Appointment

 

Long standing member John "Jack" Holland served as the City of Pompano Beach representative on the Hillsboro Inlet District as one of their Commissioners, and has subsequently retired after serving the City and the District for approximately 35 years. Therefore, it is necessary that the City Commission appoint a replacement to serve in this capacity.

 

Historical Background

 

In 1957 the Florida Legislature created the Hillsboro Inlet District. This is a special independent district that can levy taxes to finance the maintenance and improvements to the Inlet. The taxing District runs from Dixie highway to the Ocean and from the Broward/Palm Beach county line to Lauderdale by the Sea. The District has eight commissioners from: Pompano Beach, Lighthouse Point, Deerfield Beach, Hillsboro Beach, Lauderdale-by-the-Sea, Sea Ranch Lakes, Ft. Lauderdale and Broward County.

 

CHAPTER 2007-291 - House Bill No. 1137

An act relating to Hillsboro Inlet District, Broward County; amending Chapter 99-433, Laws of Florida; decreasing the number of members on the board of commissioners; revising the qualifications for appointment to the board of commissioners; providing an effective date.

 

CHAPTER 2008-283 - House Bill No. 1073

Pursuant to House Bill 1073 and its subsequent amendments to section 1, subsection (1) of section 4 and subsection (1) of section 6 of chapter 99-433, Laws of Florida, as amended by chapter 2007-291, Laws of Florida, are amended to read as follows:

 

 4. Board of Commissioners.-

 

The governing body of the Hillsboro Inlet District shall consist of eight commissioners, who shall serve without compensation, except as pro-vided in section 11. One representative on the Board of Commissioners of the Hillsboro Inlet District shall be appointed by each of the governing bodies City Commissions or Town Councils of the following municipalities: the City of Deerfield Beach, Florida; the Town of Hillsboro Beach, Florida; the City of Pompano Beach, Florida; the Town of Lauderdale-By-The-Sea, Florida; the City of Lighthouse Point, Florida; the City of Fort Lauderdale, Florida; and the Village of Sea Ranch Lakes, Florida. The Board of County Commissioners of Broward County, Florida, shall appoint one representative to the Board of Commissioners of the Hillsboro Inlet District. Each representative so appointed by the aforementioned governmental entities shall represent the respective governmental entity making such appointment. The duties, functions, and responsibilities of the district shall continue as provided for herein in the event that any municipality represented hereby is dissolved, merged, or fails to appoint representatives to the district board. Said representatives appointed by the respective municipalities shall be qualified electors, residing in the municipality from which they are appointed for more than six months prior to appointment. Effective October 1, 2007, any new representatives appointed to the district board shall also reside within the district boundaries, as described in section 3. Effective October 1, 2007, any new representative appointed by the Board of County Commissioners of Broward County shall be a qualified elector, shall reside within Broward County, and shall reside within the district’s boundaries for more than 6 months prior to appointment. Notwithstanding any other provision of this subsection, any representative on the district board as of October 1, 2006, shall be exempt from the requirement that the representative must reside within the district’s boundaries.
