Summary Explanation/Background:
In accordance with Resolution 2026-143, which grants the City Manager authority during the City Commission's August hiatus to execute and complete matters that have been budgeted and authorized, the following five (5) agreements were executed by the City Manager and/or his designee during this period. A brief summary is provided for each agreement to explain the necessity of these actions taken in August.
Three (3) Booster Club Agreements:
Pompano Cowboys Booster Club, Inc.
Pompano Chiefs Cheer and Football Program, Inc.
Pompano Beach Eagles, Inc.
The three (3) tackle football programs are currently in progress. The clubs were required to begin organizing teams, conducting practices, coordinating coaches and volunteers, purchasing equipment, and preparing for scheduled league games during August. The booster clubs provide support that is integral to the successful administration of the youth football program. There is no fiscal impact for these agreements. Having them in place as close to the start of the season established the responsibilities and expectations of both the City and the booster clubs before substantial program activities occurred.
Ratification in August also ensured that the relationship between the City and each booster club was governed by written terms during the period in which football activities were beginning. The agreements establish the respective roles, responsibilities, and requirements of the parties and provide the City with an appropriate mechanism for oversight and accountability.
FEC Lease Amendment -
The City currently leases portions of the FEC right-of-way under an agreement that is scheduled to expire on September 30, 2026. The City was advised on February 24, 2024, that the lease terms would change, specifically that the rental amount would increase from $16,745.50 annually to $207,000 in Year 1, followed by $414,000 annually in subsequent years, a1100% and 2400% increase, respectively. The City has been in negotiations with FEC since that time, identifying necessary leased areas and attempting to ascertain a reasonable rent. Recently, the City obtained an agreed amendment to extend the lease term by 1 year at a slightly increased annual rent of $20,931.75 (approximately an additional $5200 for the amendment). City staff believes this short-term amendment provides sufficient time to continue lease discussions and explore funding options.
A Grant Agreement with FAA:
New Air Traffic Control Tower Design:
The existing Air Traffic Control Tower is more than fifty (50) years old and in need of major repair and equipment upgrades. The tower does not meet the FAA’s current visibility performance requirements (height) and is in need of replacing the tower with a new facility that meets the FAA’s siting and design criteria. The total project cost for design is $1,420,000.00, with FDOT contributing 16.55% ($235,000.00), City match (Airpark Enterprise Fund) is 16.55% ($235,000.00) and FAA covering the remaining 66.9% ($950,000.00).
