Summary Explanation/Background:
Staff is seeking City Commission approval of an Ordinance to execute a contract amendment with DiPompeo Construction Corporation (DCC) in the sum of $6,166,555.84 (see document entitled 1731 GMP Amendment Ultimate Sports Park). The contract amendment will authorize DCC to carry out construction efforts related to the Ultimate Sports Park located at 212 NW 16th Street next to the Boys and Girls Club and the Broward County Northwest Branch Library (see Location Map). The Ordinance is necessary to retain DCC to provide Construction Management at Risk Services for the GO Bond Ultimate Sports Park project (see Location Map) and award a contract. On September 24. 2019, via Ordinance 2019-98, the City executed a Construction Management at Risk (CMAR) contract with the firm. The City Commission authorized staff to proceed to negotiate a Guaranteed Maximum Price (GMP) contract. The firm prepared a new GMP proposal (see Exhibit “C”) and a Project Schedule (Exhibit "E). The City's Contract Manager prepared the final document and compiled the Exhibits. Under the contract, DCC will be responsible to provide Construction Management at Risk (CMAR) services and oversee efforts to improve the park including, but not limited to, construction of a new rectangular artificial turf field with supporting sports lighting equipment; drainage facilities; bleachers; new bathrooms/changing area; landscape; sidewalks; security system, etc. (see backup pages 23-32 for more details, specific line items and schedule). The project is expected to be completed by mid-October 2023. Staff worked with the CMAR and design team extensively to value engineer the project, reduce costs without reducing quality, and to meet the objectives. During the review, staff met with Walters Zackria (architect) and evaluated design options, opportunities for savings (value engineering), simple plan changes without sacrificing the project’s objective, and more. Some of the items that were thoroughly evaluated included the roof over the new bathroom, bleacher system, and drainage, to name a few. Subsequently, staff met with the CMAR to confirm their ability to meet the City’s goals in terms of quality, product selection, etc. The result of that pre-work and analysis is reflected in the final GMP. Furthermore, the design team assisted staff with review of the proposed Guaranteed Maximum Price (GMP) (line item by line item) to ensure completeness and accuracy. And, the City’s Contract Manager and City Attorney’s Office assisted with review of the proposal as well as preparation of the contract documents and Ordinance. Staff recommends approval.
