AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF POMPANO BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A FOURTH AMENDMENT TO THE CONSTRUCTION MANAGER-AT-RISK AGREEMENT BETWEEN THE CITY OF POMPANO BEACH AND THE WHITING-TURNER CONTRACTING COMPANY FOR THE CONSTRUCTION OF SEGMENT 3 OF THE DIXIE HIGHWAY STREETSCAPE IMPROVEMENTS FROM NE 10TH STREET TO COPANS ROAD AT A GUARANTEED MAXIMUM PRICE OF $12,984,223.34, AND TO EXECUTE THE SECOND AMENDMENT TO THE INTERLOCAL AGREEMENT WITH BROWARD COUNTY UNDER THE COUNTY TRANSPORTATION SURTAX PROGRAM TO INCREASE THE SCOPE OF WORK, EXTEND THE TERM AND INCREASE MAXIMUM FUNDING AMOUNT, AND TO AUTHORIZE THE PROPER CITY OFFICIALS TO MAKE NONSUBSTANTIVE AMENDMENTS WITHOUT FURTHER COMMISSION APPROVAL AS MAY BE REQUIRED BY BROWARD COUNTY FOR PROGRAM FUNDING, NOT INCLUDING THE GUARANTEED MAXIMUM PRICE, AND TO PROVIDE COPIES OF SUCH AMENDMENTS TO THE CITY COMMISSION AND CITY CLERK; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

Summary Explanation/Background:
Staff is seeking City Commission approval of an Ordinance to enter into an agreement (see Signed Agreement and accompanying exhibits including proposed Schedule) with the Whiting-Turner Contracting Co. (WT) to assist the City with construction improvements on Dixie Highway from NE 10th Street to Copans Road (see Location Map). WT submitted a Guaranteed Maximum Price (GMP) proposal in the sum of $12,984,223.34. The funds will be utilized to continue improvements on Dixie Highway, namely resurfacing and restriping the road; updated drainage as needed to support the new roadway configuration to include medians; installation of new sidewalks; construction of new bus stops; installation of new street lighting equipment; and, new landscape supported by an irrigation system. The project is partly funded by the Penny for Transportation (Surtax), which approved this project in 2018 and set aside nearly $25 million for the corridor. For this Segment 3, Surtax is providing $12,240,069.60 of the required GMP. The remaining $744,153.74 are being funded utilizing Tree Canopy Funds. This segment is the continuation of work that WT has performed dating back to September 2019 when the City retained the firm to assist with pre-construction services and subsequent construction of Segment 1 (Dixie Highway from McNab Road to SW 3rd Street). Later, the City retained WT to construct improvements related to Segment 2 affecting Atlantic Boulevard from NW 6th Avenue to Cypress Road and Dixie Highway from SW 3rd Street to NE 10th Street. This new segment of work will result in similar upgrades and help to beautify the corridor leaving the section of Copans Road to Sample Road as the remaining portion of roadway to be completed. In addition, this Ordinance will authorize the proper City officials to sign and enter into a Second Amendment of the City’s Interlocal Agreement with Broward County for the aforementioned Surtax funding. This agreement is necessary to accept the funds and to apply the funds as intended for Segment 3. This additional segment of work is expected to be completed on/or about late summer of 2026. Staff recommends approval.
