The Utilities Department seeks City Commission approval to execute an Interlocal Agreement (ILA) among Broward County, the City of Pompano Beach, and participating municipalities to support compliance with the National Pollutant Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) permit for the next permit cycle. As one of 26 co-permittees under Broward County’s MS4 permit, the City is required to implement and maintain a comprehensive stormwater management program in accordance with federal and state regulations.

Under the ILA, Broward County will continue to serve as the lead permittee, providing regional coordination, technical services, and administrative oversight. Services shall include implementation of stormwater management programs, conducting monitoring activities, and ensuring compliance with stormwater discharge regulations and water quality standards. This approach promotes consistent, efficient, and cost-effective compliance across jurisdictions.

The agreement covers a five-year cost share totaling $164,399, to be budgeted accordingly. Approval will allow the City to meet regulatory requirements, maintain water quality standards, and avoid potential penalties, while supporting the City’s strategic goals for sustainable and resilient stormwater infrastructure.

The City shall periodically monitor and inspect the infrastructure systems required by the City’s National Pollution Discharge Elimination System (NPDES) permit in order to ascertain that the established levels of service standards are being maintained.

The City shall continue to undertake the actions to assure surface water quality including impacts on the ocean are minimized and all conditions of the City’s National Pollution Discharge Elimination System
