Summary Explanation/Background:
The applicant, Suzanne Dockerty, Esq., on behalf of St. Elizabeth Gardens, Inc., is requesting Flex Allocation approval for a maximum of 15-units included in an existing affordable rental apartment community. St. Elizabeth Gardens is located on a 7-acre property that has a Low-Medium Residential Land Use designation. The property is situated approximately 500 feet east of N. Dixie Highway, on the north side of NE 33rd Street. The existing development is composed of 153 low-income senior housing units owned and managed by the Archdiocese of Miami. The complex was built in 1970 when the property was under the jurisdiction of Broward County. In 2000, the City annexed this area and gave it the same Land Use designation and Zoning category that was comparable to the County’s at that time, which was not actually reflective of the existing use.
The applicant intends to rectify this legal-nonconforming status through the use of the City’s Flex Allocation and the Broward County Land Use Policy that was approved in 2017 allowing bonus residential density for affordable housing. By bringing this existing development into zoning conformity, the Applicant will then be able to substantially renovate and upgrade the facilities. In doing so, they will also split two units in half increasing the number of units by two, thereby bringing the total number of units to 155.
Section 154.61(E) of the Zoning Code requires applicants requesting Flex allocation to commit to providing affordable housing units. Since this entire complex is affordable, the applicant has submitted a Declaration of Restrictive Covenants (DRC) guaranteeing such status (see attached DRC instrument). Also, as per the Code requirements of Flex Allocation, a ‘conceptual site plan’ (Exhibit B of the Resolution) has been submitted by the applicant, which is actually the as-built site plan. A section of the Ordinance requires future conformity with this plan. The proposed application was unanimously recommended for approval at the March 27, 2019 Planning and Zoning Board meeting with four conditions of approval, which have been met, or have been included in the Resolution.
This flex unit request is a companion agenda item to the application to rezone the property to Residential Planned Unit Development (RPUD).
