Summary Explanation/Background:
On September 25, 2018, the City Commission adopted Resolution No. 2018-275, approving the Transportation System Surtax lnterlocal Agreement (" ILA") with Broward County ("County"), the Broward Metropolitan Planning Organization ("MPO"), and other Broward municipalities ("Municipalities"), for purposes of implementing the Transportation Surtax Program. On July 23, 2019, the City Commission adopted Resolution No. 2019-239, approving the First Amendment to the ILA and on January 26, 2021 , Resolution No. 2021-58 approving the Second Amendment to the ILA.
Over the past year+ the Broward County City Manager's Association Surtax Subcommittee ("BCCMA"), made up of 6-7 cities (Pompano Beach was represented by Assistant City Manager Suzette Sibble) representing the interests of the 31 municipalities participating in the penny for surtax program worked diligently with Broward County surtax staff and the County Administrator to effect a 3rd amendment to the ILA. The objective of which was to create a more practical and efficient process for carrying out the surtax program objectives, mutually beneficial to all participating entities. This effort required many meetings between County staff and the BCCMA Surtax Subcommittee, as well as approval of the majority membership of the BCCMA (31 municipalities). This agenda item is representative of those collective efforts. The Surtax Program will continue to evolve over its 30-year cycle and participating municipalities will continuously seek to improve program parameters in coordination with the County. To date the City of Pompano Beach has received $37.9M in surtax grant funding (Cycle 1), the highest allocation of all participating municipalities. All funds received have an executed ILA with the County. Eight-Four (84%) of surtax funding awarded have been either expended or encumbered (Dixie/Atlantic Streetscape/Safety Improvements, Riverside Drive Improvements Design, Bay Drive Neighborhood Stormwater Drainage Improvements and Kendall Lake Neighborhood Stormwater Drainage Improvements.
Key Proposed Amendments to Highlight Include:
1. Expanded eligibility criteria in line with the intent of the surtax statute governing enhanced mobility and transportation
2. A 60% carve out of the minimum annual guarantee of funds that municipalities are entitled to be used for repair and maintenance (R&M) such as road resurfacing/repaving, sidewalks and on-demand transit services. Previously emphasis was placed on construction projects and R&M was funding was not guaranteed. This amendment, subject to funding availability, further guarantees municipalities an annual allocation based on their center lane miles. This provides predictability for annual budgeting purposes.
3. A Grant Match Program whereby municipalities may leverage available surtax funds to meet match requirements for grants to fund capital projects.
