Summary Explanation/Background:
The Applicant is proposing a change in the land use designation of the 4.2079 gross-acre property located at 2507 N. Ocean Blvd and 2629 N. Riverside Drive. The property has Commercial (C) Future Land Use designation. Apart from an existing marina, the property is currently vacant. The Applicant is requesting a change in land use to High Residential (H) - Irregular 29, which would permit a maximum of 122 residential dwelling units with an overall density of 29 units per acre. The request also includes the conversion of the commercial marina to a residential marina and a maximum of 5,115 square feet of commercial accessory use. In 2007, via Ord. 2008-12, the property was rezoned from Community Business (B-2) to General Business (B-3). In 2012, via Ord. 2013-01, a portion of Riverside Drive was abandoned, based on the future development of a hotel. Per the Staff Report / Administrative Memo 16-342, Development Services Department made a recommendation of denial to the Planning and Zoning Board. The recommendation was based on the finding that the amendment is incompatible with the Comprehensive Plan and in particular three Goals and nine Policies (listed in the Staff Report). At the September 28, 2016 meeting, the Planning & Zoning Board recommended approval with a 5 to 2 vote with one condition regarding consideration of meeting the Broward County Affordable Housing requirements. The draft Ordinance includes this condition as well as a condition added by the City Attorney regarding an existing Declaration of Restrictive Covenant.
