Summary:                     

This Plat consists of 0.696 acres of remnant property left from the re-alignment of N. Andrews Ave. Land Use is I, Zoned I-1. Applicant wants to construct a 10,000 sq. ft. warehouse.

Comment:

1) This Plat is proposing to create a non-conforming lot, which is prohibited by Code.

Code Section 155.2410. D. Plat Review Standards states the following.

An application for a Plat shall be approved only on a finding that the proposed subdivision or development on the lots proposed to be platted meets all of the following standards:

1.   The development complies with the applicable standards in Part 7 (Lots) of Article 5: Development Standards;

Article 5, Part 7 (Code Section 155.5705) - Lot Dimensions requires the following for lots:

   A.   The size, shape, and orientation of lots shall be appropriate for the siting of the type of building(s) or other development that the subdivision is proposed to include or that applicable use standards allow on the lot.

   B.   Lot area and lot width shall comply with the applicable minimum standards in Article 3: Zoning Districts.

The minimum standards in Article 3 for the I-1 Zoning District is found in Section 155.3402.C.  and requires a Lot width of 100 ft.

The lot width of Parcel A is approximately 81 Ft. at its widest area.  The Applicant’s Narrative states that the width is met by combining the two lots that are separated by the Andrews Avenue overpass.  Since the two parcels are not contiguous, staff has concluded that the proposed lot does not meet the applicable standards.

2) If the applicant can add additional width, then this Plat could proceed, however given the irregular shape it would be difficult to meet development regulations such as setback and drainage requirements. Therefore, the applicant should be aware that staff would recommend a condition to the P&Z Board that all required variances for site plan approval must be obtained prior to placement on a City Commission agenda.

3) The Applicant must have Broward County Development Review Report prior to placement on Planning & Zoning Board Agenda.

4) All Right-of-Way dedications shall be reflected on Plat before placement on a City Commission agenda.

5) The Applicant must submit a Title Certificate made out to the City, less than 6 months old. This must be submitted prior to placement on a City Commission agenda.

6) The Plat cover page must be signed and sealed by the surveyor and signed by all owners prior to placement on the City Commission agenda.

Comment: The current survey shows an existing catch basin that is on private property that is connected to the city drainage system. The catch basin appears to be in the building footprint. Please check with our utility division.

This P&Z application is able to meet all of the Fire Department requirements at this time for PLAT APPROVAL ONLY. Site plan approval will be required, maintaining all proper fire department access and water supply requirements as per chapter 18 of NFPA 1 as amended from time to time.

*Additional comments may follow throughout the remainder of the permitting process. The buildings shall follow All NFPA Standards prior to receiving Fire Department approval.

There must be an understanding that the drain will be disconnected from the City’s system, as the structure does not serve a public purpose.
