Summary Explanation/Background:
This item has been separated from the measurement of the height of structures amendment. This item modifies the way the Zoning Code would measure the height of fences and walls, when atop a retaining wall. New development is being required to elevate the base of the building generally to comply with flooding requirements. As more and more properties are elevated, conflicts are being created at the property lines. The higher new development is limited to a fence height (typically 6 feet tall) where the total is measured from the lower existing grade of the adjacent property. Without the amendment, a fence on top of a retaining wall is limited so that from the exterior, the total height appears compatible. However, on the interior side of the fence, the total height of the fence may be as low as 42 inches (required for building code compliance - fall prevention barrier). This reduced height on the interior, while providing a compatible appearance on the exterior, results in a loss of privacy for both sides of the fence.
The proposal is to allow for the measurement of the perimeter fence or wall to be taken from the interior side of the fence rather than the exterior. This way, all new development is able to create expected privacy in a rear yard regardless of required property elevations.
