Summary Explanation/Background:
In 2003, an Interlocal Agreement for Public School Facility Planning was established to provide for cooperative planning between the School Board, the County and the Municipalities and to create a voluntary school mitigation program to alleviate overcrowded public schools and create necessary classroom capacity.
In 2007, this agreement was amended to include a public school concurrency program. Public School Concurrency (PSC) is a growth management tool to ensure that public school facilities are available to serve new development at the time the development impact occurs. The agreement required all new residential development to comply with development review criteria and established a Level of Service Standard for each elementary, middle and high school at 110% of permanent capacity of each facility.
The Second Amended lnterlocal Agreement for Public School Facility was amended in 2010 to modify the Level of Service Standard from 110% permanent capacity to 100% gross capacity (including relocatables/portables) until the end of the 2018/19 school year. Commencing in the 2019/20 school year, the Level of Service reverts back to 110% permanent capacity. The rationale for the reversion back to permanent capacity was to not count relocatables towards capacity.
The main purpose of the proposed Third Amended lnterlocal Agreement for Public School Facility (TRILA) is to define Level of Service for school concurrency as the higher of: 100% gross capacity or 110% permanent capacity. This change would allow relocatables/portables to be counted toward capacity and thus reduce the number of Level of Service deficiencies within the County.
In order for the TRILA to become effective, it must be approved by the School Board, Broward County and at least seventy-five percent (75%) of the cities which include at least fifty percent (50%) of the population within Broward County. The School Board and Broward County have already approved the amendment, and 16 of the 27 cities of Broward County have also approved it. Therefore, once the amendment is approved by five more cities, it will become effective for all of Broward County.
The resolution being considered has as an attachment the actual amendment, but staff has also included a version of the amendment showing the specific cross-hatched deletions and underlined additions for the Commission’s convenience.
School Level of service is not a measure of the quality of instruction, but rather by the number of student seats being counted over or under the capacity of any given school. Table 1 provides an analysis reflecting the effect of the proposed amendment on the Level of Service for all schools in Broward County. On this table, Pompano Beach schools are highlighted in light yellow and schools that do not meet the Level of Service standard have a gold-colored box with “No” shown in that column. The table indicates that the City of Pompano Beach will still meet the Level of Service standard in 2019/20 even if this amendment does not get approved. However, four of the City’s schools (circled) show they are further away from being over capacity by relying on the use of portables and therefore would get relief from the flexibility of this amendment. Also, there is the possibility that with the City’s expected growth, there is even greater potential relief with the flexibility of the amendment in the future. Furthermore, if this amendment is approved, other cities within Broward County that do have a concurrency problem will immediately find relief from having to make boundary changes to meet the Level of Service standard. It is for these reasons that the Development Services staff recommends approval of this amendment to the Interlocal Agreement for Public School Facility Planning.
