Summary Explanation/Background:

The City, the CRA and RP Pompano, LLC. (Developer) are parties to a Master Development Agreement (MDA) approved by Resolution No. 2024-154 (City) and Resolution No. 2024-33 (CRA) on June 20, 2024.  The MDA provides for a mixed-use development of a New Downtown including the construction of a new City Hall and parking garage included in the Master Plan Concept. There are various technical matters that are required to be addressed in connection with the development of the project such as easement vacations, utility relocations, utility agreements, right-of-way vacations, platting, land records, water and sewer infrastructure, stormwater management and site plan review of City Hall and parking garage (the Technical Matters).  In an effort to facilitate prompt and efficient development of the Master Project, staff is recommending that the City Contract Administrator, in concurrence with the City Engineer or the Director of Development Services, as applicable, be the designated authority to administratively address the Technical Matters that arise from the MDA, specifically as this relates to the development of City Hall and associated garage parking. This designation of an administrative authority is consistent with various provisions of the City Code and recent changes to State law relating to plat and replat approvals. The City Contract Administrator and the Developer shall ensure that no right-of-way shall be vacated before an easement dedication or creation of an alternative right-of-way has been created, if necessary.  Additionally, the City Contract Administrator shall provide the City Commission with a monthly written report of Technical Matters that have been approved.
