Summary Explanation/Background:

This is a reconsideration of the Usman Palmaire Flex Allocation Request originally heard on September 24, 2019, where the City Commission voted to deny the allocation of 58 units (see attached Commission Minutes excerpt). On September 24, 2019, upon request of the applicant, the City Commission voted in favor of a rehearing regarding the allocation request. The applicant reduced the number of requested Flex units from 58 to 40 units and on held a Neighborhood meeting on January 6, 2020, to address concerns. The Flex request was rescheduled for a hearing in April of 2020, however all Quasi-judicial meetings had to be stricken from that agenda. The applicant has now requested to be heard at this hearing (see attached Dec. 29th request letter).

Background:
The Applicant, Joe Usman of Usman Palmaire, LLC, has submitted a request for 40 flexibility units for the 1.3-acre property at 1001 S. Pompano Parkway.  The flex allocation is necessary because the property had not previously been allocated residential units in the Palm Aire Stipulated Settlement Agreement. Now that the units allocated to the Palm Aire Dashed Line land use district have been fully allocated, the allocation of flexibility units is the best method for allowing residential development of the site.  The property is within the City’s flex receiving area and is eligible for flex units.  The site is zoned RM 45 and can accommodate the requested 40 units under the approved density for the site.  The Planning and Zoning Board unanimously recommended approval of this request at their meeting on June 26, 2019 with three conditions (see attached P&Z Approval Memo #19-023 & the P&Z Minutes Excerpt). The P&Z Board approval conditions will be met at the time of site plan approval. Subsequent to the vote to reconsider, on January 27, 2020, the Pompano Beach Economic Development Council voted in support of the allocation of units for the project (see attached EDC Approval Memo).
