Summary Explanation/Background:
The proposed ordinance are amendments to Chapter 153, Rental Housing, to create a Short Term Rental Permit program. In Administrative Memo #17-065 the Short Term Rental Staff Taskforce identified its goals and one of the short term goals is the adoption of a Short Term Rental Permit program. The recommended text amendments are based on the specific issues regarding Short Term Rentals occurring in Pompano Beach, limited home rule authority to regulate short term rentals per Florida Statutes, and research of best practices. The Short Term Rental Permit would be required for single family, duplex, triplex, and quadplex dwellings that are available for rent for a period of 6 months or less. These unit types would be required to comply with additional standards regarding off-street parking, garbage receptacles, and responsibilities for the 24-hour local contact. Prior to the issuance of the Permit, the properties and structures must be inspected and the proposed application fee includes the increased administrative time and mandatory inspections required. With a 4 to 2 vote, the Planning and Zoning Board recommended the text amendments at their February 22, 2017 hearing. Based on the anticipated increased administrative staff time to implement the Short Term Rental Permit program, this item requests a new staff position with an annual cost of approximately $60,000, which will be potentially offset with the fees included within the ordinance. Administrative Memo #17-136 provides additional information regarding the duties and cost of the new staff position.
