Summary Explanation/Background:
This application is a modification to the Hillsboro Shores LUPA application previously approved on first reading at the December 13, 2016, City Commission meeting. The application originally requested changing the Commercial Land Use designation to High Residential (H) - Irregular 29 and included 122 dwelling units based on 4.2079 gross acres. After first reading approval at the City Commission in a 4-2 vote (see attached Minutes), the application was then transmitted to the Broward County Planning Council. The BCPC Staff ruled that the subject property gross acreage could not include the submerged land located in the Intracoastal Waterway. Therefore, the applicant has modified the application’s gross acreage, but is retaining the proposed 122 unit count. As a result, the modified application is for High Residential (H) - Irregular 35.7 (instead of irregular 29), and has a gross acreage of 3.4256 acres (instead of 4.2079). Staff’s analysis and recommendation of denial did not change. It was heard at the April 26, 2017 Planning Board Meeting and unanimously recommended for approval with one condition of implementation which was to consider the Broward County Affordable Housing requirements. In Exhibit B of the Ordinance the following is required to facilitate such: No Building permits shall be issued until the affordable housing units shall be provided in accordance with the requirements of Broward County Land Use Plan Policy 1.07.07., which can be accommodated through the Pompano Beach “In-Lieu Fee” for Affordable Housing.
