Summary:                     

The applicant is requesting approval of a Minor Site Plan application in order to revise the parking lot layout of the northern half of the subject property and install compressed natural gas (CNG) equipment to be distributed to trucks on site. This application is associated with the previously approved site plan, PZ 23-12000025, that reconfigured the parking lot on the southern half of the property.

1.                     Info only: this submittal is being reviewed as a Minor Site Plan.

2.                     With the combination of this submittal and the last site plan of record from 2023 (PZ 23-12000025), the site is now being completely re-done and is required to come into full compliance with the code, per the condition of approval from the 2023 site plan. Revise the site plan to show the full site plan as one plan with the full details as previously approved plus the new proposal.

3.                     The property has an open permit for the scope of work from the previous 2023 site plan (BP 25-2465). The property owner shall finalize this initial work and revise the permit to include the scope of work proposed on the north side, providing a full/complete site plan for this permit.

4.                     Revise the site plan, as previously approved, to show all curbed areas with a solid line and not dotted lines. All landscape and parking areas should be curbed.

5.                     Also show the curbing on the civil pavement parking plan as solid lines, per the previously approved plan. The plan submitted shows the rest of the property with dotted lines. Revise.

6.                     Based on both the site’s aerials and Staff inspections, the site is exceeding the maximum permitted outdoor storage area. The applicant shall submit for a Special Exception approval to permit more than the 35% outdoor storage on site.

7.                     Revise the site plan to call out the areas of outdoor storage that exceed the existing 4,214 SF outdoor storage area. Outdoor storage as a principal use shall be screened and have buffers in accordance with section 155.4228.A.

8.                     Re-add all noted on the plan and on the right side of the site plan stating “All electrified and barbed wire fencing shall be removed from the property”. These fence types are not permitted within the City and there are no permits on record for the existing electric/barbed wire fences.

9.                     In accordance with the 2023 site plan conditions of approval, the site shall remove all chain link fencing facing the streets in order to come into full code compliance. Chain link fences are prohibited along arterial and collector streets (155.5302.G) and within 15 feet of the right-of-way (155.5302.E). The existing chain-link fence along MLK Blvd, NW 15th Court, and NW 26th Ave shall not be replaced as well as the sides of these property lines for a length of 15 feet.

10.                     The dotted lines in the parking areas are unclear. Adjust the scope of work line within the center parking, east of the warehouse building, so that it is clear where the landscape islands and the parking are located. There are too many dotted lines.

11.                     The left and right landscape corners in the center parking, east of the warehouse building, do not match the landscape plan. Revise to be consistent/clear.

12.                     Clarify what the squares with the dots in the middle represent that are located in the landscape islands around parking spaces 77-86. This symbol is shown on most plans but easily noticed on sheet 44 C-100.

13.                     The site plan notes a new swing gate along the north property line. Clarify which direction it will swing. Note that it is not permitted to swing out, into the public ROW. Provide the height and type of swing gate proposed on the plan. Chain link is not permitted.

14.                     All gates must be located within the property lines in order to accommodate the required stacking distance of 3 parking spaces, which in this case are 35’ long. Therefore, the gate shall be located 105 ft into the property. Alternatively, the gates shall remain open during business hours to accommodate the stacking. If this is desired, add a note to the site plan stating “All gates on site will remain open during business hours.”

15.                     Confirm on the site plan that the eastern green area is maintaining the 11’ width and that the new guardrail and gas pumps are outside of this. The site plan dimensions are unclear.

16.                     Provide a curb along the green area measuring 38.2’ in the northeast section of the property where the edge of pavement is called out.

17.                     Provide a curb along the front ends of all parking spaces, before the guardrails. The guardrails shall not replace the requirement of the curb.

 

 

 

 

 

LANDSCAPE REVIEW

1.                     Submit a tree survey prepared, signed, and sealed by a Florida Registered Surveyor showing the locations of all existing trees and palms in accordance with Code Section 155.2411, and Part 5.

2.                     Submit a Tree Assessment and Appraisal prepared by an ISA Certified Arborist in accordance with FS Rule 14-10.057 of the Florida Administrative Code as amended, for all trees that are specimen (18” or greater and health condition of 60% or greater), and all palms trees; provide DBH for all non-specimen trees (no individual $ value shall be provided); assign each existing tree a number; specify the common and botanical name for each existing tree; provide the height for each existing tree; provide the DBH for each existing tree (excluding palms trees); evaluate the health condition of each existing tree; identify the status of each existing tree (whether the tree is to be protected in place, relocated, or removed); and provides a dollar value for each existing tree included on the tree survey in accordance with Code Section 155.2411, 155.5204, and Article 9 Part 5.Provide methodology for tree appraisal as all values appear to be low. All trees are to be appraised based on the Rule 14-10.057, Florida Administrative Code, provide worksheets for all the trees appraised.

3.                     Provide a Tree Disposition Table reflecting the following: Total Hardwood Specimen Tree $ Value to be Removed; Total Hardwood Specimen Tree $ Value to be Relocated; Total Hardwood Specimen Tree $ Value to be Protected; Total Palm tree $ Value to be Removed; Total Palm tree $ Value to be Relocated; Total Palm tree $ Value to be Protected; Total Non-Specimen Tree DBH inches to be Removed; Total Non-Specimen Tree DBH inches to be Relocated; Total Non-Specimen Tree DBH inches to be Protected.

4.                     Provide a Tree Mitigation Table that clearly shows the following: Total Hardwood Specimen Tree $ Value to be Removed vs. Replaced; Total Palm tree $ Value to be Removed vs Replaced; Total Non-Specimen Tree DHB inches to be Removed vs Caliper inches to be Replaced. Note, mitigation is above and beyond minimum tree requirements for the site.

5.                     Provide a data table showing how the site is meeting the requirements of 155.5203. C Minimum Site Development Landscaping.

6.                     No exterior lighting fixtures shall be located in any landscaped planting areas required in and around vehicular uses areas in accordance with Section 155.5401.C, Vehicular Use Area Landscaping (e.g., perimeter landscaping strips, landscaped islands in parking bays, landscaped areas between parking bays, and landscaping between vehicular use areas and buildings).

7.                     Clearly show light poles on the landscape plans and show the 15’ radius. Coordinate light pole locations with the photometric plan.

8.                     As per 155.5203.D.4. VUA provide an 8’ wide landscape area with a continuous hedge and 1 large canopy tree per 40’ between abutting parking rows. Six trees are required, add one tree in the head to head parking row.

9.                     As per 155.5102.C.9; provide continuous curbing around all VUA area to prohibit vehicular encroachment into required landscaping. In addition, show all curbing as a solid line and if desired, label all new proposed curbs.

10.                     Provide interior landscape requirements equal to 15% of the total vehicular use area, this shall be provided and maintained within the interior of a vehicular use area as per 155.5203.D.4., provide this information in a data table format on the landscape plans.

11.                     Provide Street Trees at 1:40’ as per 155.5203.G.2.c. Add 3 trees top the northern right of way.

12.                     Provide required Type B Perimeter Buffers on East, North, West, and South sides as per 155.5203.F.3. and provide a cross section details.

13.                     Show on the plans and provide a dumpster detail including hedges in accordance with 155.5301.C

14.                     Show overhead and underground utilities on landscape plan

15.                     Provide VUA trees on the south side of the new proposed parking area.

16.                     Clarify are at NE corner of property; in addition provide required screening.

17.                     Clearly define proposed outdoor storage on the plans as it appears many areas throughout the site are currently being used for outdoor storage.

18.                     Provide a different symbol for palms on the plans.

19.                     Reference all associated permit numbers and site plan numbers on the overall landscape plan.

20.                     Provide plant list on sheets LP-1.01 and LP-1.02.

21.                     All tree work will require permitting by a Broward County Tree Trimmer.

22.                     Submit a Tree Permit Application for all proposed tree work.

23.                     Provide a detailed comments response at the time of re-submittal.

PROPOSED CAMERA AND MONITORING LOCATIONS WILL BE COORDINATED WITH A SECURITY AND ACCESS CONTROL CONSULTANT AND THE BROWARD SHERIFFS OFFICE CPTED REVIEWER *** PRIOR *** TO PERMITTING. PLANNING AND INSTALLATION OF THE SURVEILLANCE MONITORING SYSTEM MUST INCLUDE FIELD INPUT FROM EXPERIENCED CPTED/ SECURITY STRENGTHENING LAW-ENFORCEMENT TO PROVIDE OPTIONS TO CONSIDER TO AID IN ENSURING OPTIMAL RESULTS.

1.) Electronic surveillance cameras must be strategically located for maximum active and passive observation. Show sight cones indicating comprehensive coverage. Cameras must cover the parking lots, buildings, egress and ingress points and CNG storage area.

 

2.) Surveillance Monitors depicting real time security camera views must be strategically located for maximum overlapping active and passive observation.

3.) Install hard-wired burglar security alarms at any commercial property, retail businesses and residential management offices, and/ or wherever valuables of any kind are stored. Alarms must be monitored and activated whenever businesses are closed, or all personnel are out of the building offices.

(Since this is a highly combustible fuel, the gates need to be alarmed)

 

B2. Access Control Security Strengthening for Key Control & Management Offices

 

1.) Key security office / room / key storage closet door must have an alarm and robust mechanical locking system.

Advisory Comments


A preliminary examination of the documents has been performed; additional comments may apply when completed plans and/or specifications have been submitted for permitting to the building department.
Buildings shall comply with all local, state and federal codes in effect at time of application, including FEMA Floodplain, NPDES and HVHZ regulations.

FBC_BCA 105.2.3 Public service agencies/other approvals. The building official shall require that the laws, rules and regulations of any other regulatory AHJ, and where such laws, rules and regulations are applicable and are known to the building official, shall be satisfied before a permit shall be issued. The building official shall require such evidence, as in his or her opinion is reasonable, to show such other approvals.

City Ordinance 53.16(A)(1) Construction sites and construction activities. construction sites and operations shall be required to maintain during and after all construction, development excavation or alteration operations, structural and non-structural best management practices with the intent to reduce pollutants and sediment in stormwater runoff.

City Ordinance 152.06(A): If applicable, contractor shall provide temporary screened fence complying with City Ordinance 152.06(B) through 152.06(G).

FBC 3306.1 Pedestrians shall be protected during construction, remodeling and demolition activities as required by this Chapter and Table 3306.1. Signs shall be provided to direct pedestrian traffic.

FHA Title VIII of the Civil Rights Act of 1968, commonly known as the Fair Housing Act, prohibits discrimination in the sale, rental, and financing of dwellings based on race, color, religion, sex, and national origin. In 1988, Congress passed the Fair Housing Amendments Act. The Amendments expand coverage of Title VIII to prohibit discriminatory housing practices based on disability and familial status.

FBC A206.2.1 Site arrival points. At least one accessible route shall be provided within the site from accessible parking spaces complying with FBC A502 and accessible passenger loading zones complying with FBC A209; public streets and sidewalks; and public transportation stops to the accessible building or facility entrance they serve.

FBC_BCA 107.3.4.0.6 Compliance with the specific minimum requirements of this code shall not be in itself deemed sufficient to assure that a building or structure complies with all of the requirements of this code. it is the responsibility of the architect and/or engineer of record for the building, structure or facility to determine through rational analysis what design requirements are necessary to comply with 2023 FBC.

1.FBC_BCA 107.1 As per the building official, separate building applications will be required for erosion control, site work, temporary fences, monumental signage and miscellaneous site structures

2.F.S. 481.221(2) The enforcing agency will require digital signature panel to be active on all documents submitted for review to authenticate the serial number matches the submitted ESA. F.A.C. 61g1-16.005 Each sheet is required to be digitally or electronically signed, and bear the impress seal of, an architect or engineer (FBC_BCA 107.3.4.0.1).

3.FBC_BCA 107.3.4.0.8 All plans and/or specifications prepared by an architect or an engineer pursuant to the requirements of this code shall be hand signed, dated and sealed.

4.FBC 3303.5 Water Accumulation. The enforcing agency will require provisions be made to prevent the accumulation of water or damage to any foundations on the premises or the adjoining property.

5.FBC_BCA 110.13.2.1 It shall be the joint responsibility of any owner of real property upon which construction is occurring, and any contractor responsible for said construction, to ensure that all road rights-of-way remain free at all times of all construction waste and trash resulting from such construction, and that all waste and trash resulting from the construction are contained on the real property upon which the construction occurs.

6.FBC_BCA 109.3 Building Permit Valuations. The applicant for a permit shall provide an estimated permit value at a time of application. Permit valuations, shall include total value of work, including materials and labor, for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment and permanent systems.

7.FBC_BCA 110.8.5.4 All plans for the building which are required to be signed and sealed by the architect or engineer of record contain a statement that, to the best of the architects or engineers knowledge, the plans and specifications comply with the applicable minimum building codes and the applicable fire-safety standards as determined by the local authority in accordance with this section and chapter 633, Florida Statutes.
