AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF POMPANO BEACH, FLORIDA, APPROVING AND AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF POMPANO BEACH AND BROWARD COUNTY TO PROVIDE COMMUNITY SHUTTLE SERVICE AND AUTHORIZING THE CITY MANAGER TO EXTEND THE AGREEMENT’S TERM UP TO TWO ADDITIONAL ONE YEAR RENEWAL PERIODS UNDER THE SAME TERMS AND CONDITIONS WITHOUT FURTHER CITY COMMISSION APPROVAL; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

Summary Explanation/Background:
The Community Shuttle Program started in September, 2014. Since then, the City and Broward County have expanded their operations by offering four different community shuttle routes, free of charge to the residents. Routes, schedules and maps are described in the “Exhibit A” of this Interlocal Agreement (ILA).
The City wishes to continue to provide Community Shuttle Service for its residents. The existing ILA with Broward County expires in September 30, 2019. The new ILA shall begin on the date it is fully executed by the parties and shall end on September 30, 2022. The term may be extended for up to two (2) additional one (1) year renewal periods upon written approval of the County’s Contract Administrator at least ninety (90) days prior to the expiration date of the current term.
Funding though Surtax receipts: The County agrees to pay City’s costs for operations and maintenance ("O&M") of Community Shuttle Service that is actually performed by City at the established O&M rate of forty-one dollars and ten cents ($41.10) for Total Vehicle Hours (schedule as indicated in the Exhibit F). Funding shall be used by City solely for the purpose of providing Community Shuttle Service and for maintaining, operating, and properly equipping the Vehicle(s) (funding may be used for no other purpose). City may lease Vehicle(s) from City’s Subcontractor. The cost of such leased Vehicle(s) is captured in City’s Operations and Maintenance rate.

Fiscal impact and source of funding: $339,568.20 is the estimated cost of the Community Shuttle Program for FY 2020/Local Option Gas Tax for Transit, Special Service Fund. Per the New ILA the reimbursement rate is $41.10 for Total Vehicle Hours.
