-Land use for this parcel is Commercial (C); Zoning is Heavy Business (B-4). The proposed use for the site is Heavy Truck/Recreational Vehicle/Trailer Rental, with outdoor display. Which is permitted by both the land use and the zoning.

 

-A portion of the property is platted Walton Site Parcel A (book 138, page 42). Administrative Rules Document: Broward Next, Article 4 - Platting Requirements does not require platting for site improvements. With this application no additions to existing structures or new structures are proposed. Therefore, the application is exempt from Platting any unplatted portion of the property.

 

-Walton Site Parcel A includes a 50x62 access easement with a note No Parking. This appears to conflict with the area shown for outdoor display on the site plan. Please revise

 

- "The Declaration of Restrictive Covenants does not state that Heavy Truck/Recreational Vehicle/Trailer Rental is prohibited use. Recreational Vehicle rentals were not intended to be prohibited, this use is distinct from the uses listed in the Declaration of Restricted Covenants." Additionally, RV rentals has been an active use on this property for many years. The owner would not restrict an active use with a self-imposed declaration. It is understood that the restriction is intended to apply to freight trucks and trailers.

 

- Please correct the easement location that is shown outside the north property line.

 

- The property is abuts Dr ML King Jr Blvd. The survey does not provide a dimension for the right-of-way or the center line of the roadway. The roadway is identified in Chapter 100.01, Code of Ordinances and on the Broward County Trafficways Plan requiring a minimum width of 106 feet. Provide a survey showing sufficient ROW width (measured to Center Line of Road) and show these same dimensions on the site plan.

 

-The city has sufficient water/waste water treatment capacity to accommodate the proposal.

Resubmittal Required

 

1.                     This submittal is being reviewed as a Minor Site Plan. The use this project is being reviewed as is “Heavy Truck/Recreational Vehicle/Trailer Rental” (155.4219.U), which is a permitted use in the B-4 zoning district.

2.                     Drive aisles must be 12’ wide if one-way or 24’ wide if two-way. The current proposal does not provide enough space to drive around the three sectioned display areas to the south. Revise so that the drive aisles are the appropriate size.

3.                     On the site plan, provide double stripping for the parking spaces within the display areas to delineate these spaces on site. All display vehicles shall be parked within designated spaces (155.4219.A.2.c).

4.                     The topo survey (sheets 105-106) does not show the required 5’ landscape easement along the north property line inside of the property. This survey shows it outside of the property. Revise the survey to move it inside of the property per the Declaration of Covenants (ORB 43659, PG 1954) on this property. Confirm that all easements have been abstracted (note so on the survey) and put all of them on this updated survey.

5.                     Likewise, show the northern 5’ landscape easement inside the property on the site plan in accordance with ORB 43659, PG 1954.

6.                     Provide a note on the site plan stating the that sliding gate will remain open during business hours. If this note is not provided, the site plan must be revised to illustrate a stacking space of 54’ from the property line.

7.                     A utility easement application will be required at time of permitting for the construction of the display areas within the utility easements in the middle of the property.

FBC_BCA 107.1 As per the building official, separate building applications will be required for erosion control, site work, temporary fences, monumental signage and miscellaneous site structures. 2. FBC_BCA 105.9 Asbestos. The enforcing agency shall require each building permit for the demolition or renovation of an existing structure to contain an asbestos notification statement which indicates the owner’s or operator’s responsibility to comply with the provisions of section 469.003 Florida Statutes and to notify the department of environmental protection of his or her intentions to remove asbestos, when applicable, in accordance with state and federal law. Contractor will be required to submit Broward County asbestos program certificate of submittal indicating that the statement of responsibility has been submitted. 3. F.S. 481.221(2) The enforcing agency will require digital signature panel to be active on all documents submitted for review to authenticate the serial number matches the submitted ESA. F.A.C. 61g1-16.005 Each sheet is required to be digitally or electronically signed, and bear the impress seal of, an architect or engineer (FBC_BCA 107.3.4.0.1). 4. FBC_BCA 107.3.4.0.8 All plans and/or specifications prepared by an architect or an engineer pursuant to the requirements of this code shall be hand signed, dated and sealed. 5. FBC A208.2 Minimum number. Parking spaces complying with 502 shall be provided in accordance with table 208.2 except as required by 208.2.1, 208.2.2, and 208.2.3. FBC_BCA 110.13.2.1 It shall be the joint responsibility of any owner of real property upon which construction is occurring, and any contractor responsible for said construction, to ensure that all road rights-of-way remain free at all times of all construction waste and trash resulting from such construction, and that all waste and trash resulting from the construction are contained on the real property upon which the construction occurs. 9. FBC_BCA 109.3 Building Permit Valuations. The applicant for a permit shall provide an estimated permit value at a time of application. Permit valuations, shall include total value of work, including materials and labor, for which the permit is being issued, such as electrical, gas, mechanical, plumbing equipment and permanent systems. 10.
