This is a request to abandon a 7-foot utility easement and a 5-foot utility easement by the Applicant’s agent, Mike Amodio of Keith, for the property at 2400 East Atlantic Boulevard.

The subject property is currently in the permitting process for site work to remove all existing infrastructure from the easements to be abandoned and otherwise prepare the site for development. The property is planned to be developed as a mixed-use project which received Major Site Plan approval via Development Order #25-12000001. As a condition of the Development Order, all existing easements that are in conflict with the proposed development must be abandoned including the subject 7-foot and the 5-foot utility easements. There are four other easements on site which were created by private agreement between the owner and FPL. The termination of those easement agreements will be coordinated separately.

B. Development Services Department staff submits the following factual information which is relevant to this abandonment request:

1.                     Both easements requested to be abandoned are located within the Pinehurst Plat. The 7-foot utility easement is located on the south 7 feet of lots 2 and 3 and the 5-foot utility easement is located on the south 2.5 feet of lot 1 and the north 2.5 feet of the east 52.30 feet of lot 7.

C. Review Standards

Section 155.2431 D. 1 and 2 states that an application for vacation or abandonment of a public right-of-way or easement shall be approved only on a finding that all of the following standards are met:

1.                     The right-of-way or easement is not now, or in the foreseeable future, of any benefit to the city or its inhabitants; and

2.                     Vacation or abandonment of the right-of-way or easement is consistent with the comprehensive plan.

D. Staff Analysis

The subject property on 2400 East Atlantic Boulevard contains, among other easements, a 7-foot utility easement running across the property through lots 2 and 3 and a 5-foot utility easement located on the south end of lot 1 and north end of lot 7. One of the conditions of approval listed in the development order for the proposed mixed-use site plan is for the applicant to abandon all existing easements that are in conflict with the proposed development, the applicant therefore must abandon both of these utility easements. All other easements on site that conflict with the proposed site plan are private agreements between the property owner and FPL. These agreements will be terminated separately.

With the removal of the infrastructure within the easements to be abandoned, which is required as a condition of approval by City Engineering, Utilities and AT&T, these easements meet the standards of Section 155.2431D.1 and 2.  As previously noted, the permit to remove the existing infrastructure from these easements is part of the site work permit currently being reviewed by the City.  Staff recommends approval of this request.

 

DEPARTMENT RECOMMENDATION

Given the information provided to the Board, staff recommends approval and provides the following motion for the Board’s consideration.

I- Approve with conditions

Recommend approval to the City Commission as the Board finds that the abandonment of both easements meet the standards of Section 155.2431D.1 and 2, with the following condition to be completed prior to the City Commission hearings:

1.                     The Applicant must comply with the conditions established by the City’s Utilities Department, the City’s Engineering Department, and AT&T to remove the existing infrastructure within the easements prior to abandonment.
