Summary Explanation/Background:

At the direction of the City Manager, pursuant to the request of Attorney Thomas W. Johnston on behalf of Mr. Ed Wolff, a retired Pompano Beach Police Officer, this matter has been placed on the agenda for City Commission’s consideration. 

According to the information provided, there were three individuals sent from the City of Pompano Beach/BSO to the World Trade Center site after its collapse on September 11, 2001.  There were two firefighters and Mr. Wolff who went with his search dog.  Mr. Wolff has received a normal retirement from the City’s retirement system, and would like the Board to consider converting that into a “9/11 service incurred disability”.  With the suggested amendment to the current Ordinance, and based on Retirement Board’s staff review, there will be only two (2) people who quality, as there are only two (2) that would remain eligible; one of the mentioned firefighters has resigned from the City and would not be eligible for a retirement benefit.  It will be a closed class involving only two potential individuals and no one else.  This will allow them to qualify for certain favorable tax treatment on the payment of their disability without cost to the fund, and together will help them participate in the “World Trade Center Federal Victim Compensation Fund”.

Additionally, at the direction and with the approval of the Pompano Beach Police & Firefighters’ Retirement System, the actuarial firm of Nyhart has provided an actuarial impact statement.  From discussions with Retirement Board staff, only two members would be affected by this language change.  Nyhart has opined that the difference is immaterial in terms of the plan’s total measured liability and contribution obligation.  Further, Hyhart believes there would be no additional funding requirements resulting from the proposed change.
