Summary Explanation/Background:

Pursuant to Section 100.01 and 155.5704, 10 feet of additional right-of-way along NW 19th Avenue is required to be conveyed to the City by the City owned property located at 720 NW 19th Avenue. The Subject City owned property is existing non-conforming and is intended to be combined with the adjacent City owned parcel (folio no. 484234040720) in order to bid the project to a prospective affordable housing development project, and as such requires a 50-foot right-of-way. Typically a Quit Claim or Warranty Deed for the portion of property to be dedicated including the legal description is required; however, since both properties are City owned a Clarification and Restatement of the Roadway is required, along with the survey and legal description, to be recorded.

Therefore, we respectfully recommend approval of the Resolution for Clarification and Restatement of the Roadway segment located adjacent to 720 NW 19th Avenue to accommodate a 50’ right-of-way for NW 19th Avenue, providing for the recording of the survey as right-of-way.
