Summary Explanation/Background:
On May 25, 2016 the Planning & Zoning Board of the City of Pompano Beach approved a Major Site Plan application for construction of a 116 unit low-income residential development and related site improvements at N Flagler Avenue between NE 4 Street and NE 5 Street. (PZ # 16-12000001 “Heritage at Pompano Station”). Improvements required by code section 155.3708(J), and shown on the approved plan (Exhibit “B” of the Agreement), are proposed both on private and on Florida East Coast Railway (FEC) property. The Department of Development Services is seeking to enter into a Developer’s Agreement with Heritage at Pompano Housing Partners, LP, in order to ensure improvements to N Flagler Avenue, as required by Code, are constructed. North Flagler Avenue is located on property that is owned by the FEC and leased by the City. As part of the agreement, the City will apply for approval from the FEC for the improvements on the leased area. The $3,000 fiscal impact is the required FEC application fee.
