This rezoning request is by Dwayne Dickerson of Dunay, Miskel & Backman, LLP on behalf of the owner, ST 33, LLC, LC 33, LLC, DS 33, LLC, VAS 33, LLC & MZ 33, LLC. The request is to rezone the subject property from I-1 (General Industrial) to I-1X (Special Industrial). The property is located at 1741 NW 33rd Street, on the north side of NW 33rd Street, between N. Powerline Road and NW 16th Avenue. The 4.71- acre subject property is occupied by a 41,821-square foot wholesale business. By rezoning, the Applicant intends to expand the types of industrial uses allowed for potential tenants on this property. In order to meet the compatibility requirements, the Applicant submitted a Voluntary Restrictive Covenant restricting the allowable uses to prohibit Sexually-Oriented Business and Fortune Telling uses. This rezoning request was unanimously approved by the Planning and Zoning Board on September 28, 2022 with the Condition that the Applicant provide the Voluntary Restrictive Covenant. This condition has been met.
