Summary Explanation/Background:

The Utilities Department seeks City Commission approval to appropriate $600,000 from the Utilities Fund Balance to fund an in-kind project submitted to the Florida Department of Environmental Protection (FDEP) to offset penalties under Consent Order No. 25-0457. The Consent Order pertains to six agreed-upon sanitary sewer overflow (SSO) violations that occurred between 2022 and 2023. In lieu of penalties, the Department opted to fund the SE 9 Avenue Force Main Pipe Bursting Project, a location that is in need of wastewater improvements but is unfunded. The project will further strengthen the overall wastewater infrastructure, reduce the likelihood of future SSOs, and meet the requirement for non-preallocated funding. Staff recommends approval of the budget amendment, which increases the Utility R&R Fund appropriation authority by $600,000.
