Summary Explanation/Background:
This is a City-initiated request to abandon a right-of-way shown on the Avalon Garden Estates 1st Addition Plat. The subject right-of-way consists of swale area located along the east and west sides of NE 26th Avenue north of NE 13th Street. It can be partially abandoned because the segment is wider than required for a residential street. The 5 feet to be abandoned on the east side will accommodate a utility line running along the eastern side of NE 26 Avenue while 10 feet can be abandoned along the west side. A utility easement will be retained over the entire area being abandoned. There were two adjacent property owners that chose to not be included in the abandonment so those lots are not included in the area to be abandoned. At the September 27th Planning & Zoning Board Meeting, the Board unanimously recommended approval of the request with one condition that has been met.
