Summary Explanation/Background:
Resolution No 22-57 previously approved by Commission on January 25th, 2022 requires rescindment as there was an error discovered in the easement that implied County was required to maintain Bus Shelter #1533 (attached). This is not accurate since there is an existing Maintenance Agreement in place where City is responsible to maintain this bus shelter (attached). As such, a new, proposed easement modifying the language is required to be entered into between County and City (attached).
As background, at the request of the City, County Bus Shelter No. 1533 was relocated to City owned park along Cypress Rd. just south of SW 6th St, and this was accomplished at County’s expense. It was agreed that County could perform this relocation via City issued permit, with the intent of City providing an easement to County in the future. As such, County is requesting the attached easement from City since the bus shelter is owned by them.
