Summary Explanation/Background:

This Revocable License Agreement between the City and 3151 NF Owner LLC is necessary to allow an existing 6-foot-high wall and associated landscaping within the NE 17 Avenue right-of-way, west of the property located at 3151 North Federal Hwy, to continue to exist at its current location. The wall was previously located on the property line; however, a 5-foot right-of-way dedication along the east side of NE 17 Avenue was required as part of a Major Site Plan approval for that site. The dedication caused the wall to subsequently be located in the right-of-way. The developer expressed a desire to maintain the wall at its existing location; hence, a Revocable License Agreement is required for the continuation of private improvements within a public right-of-way. The developer intends to repair and upgrade the wall’s appearance as part of the development of the property. If, at some point, it becomes necessary to improve this section of the right of way, the wall will have to be relocated on to the private property, at the owner’s expense. The development is for a 302-unit mixed-use Live Local project, which was approved on February 12, 2025. The site plan is included in the back up for reference.
