AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF POMPANO BEACH, FLORIDA, AMENDING CHAPTER 98, "PARKS AND PLAYGROUNDS," OF THE CITY OF POMPANO BEACH CODE OF ORDINANCES BY AMENDING SECTION 98.07, “PUBLIC EVENT,” TO PROVIDE FOR COMPENSATION FOR THE COSTS OF CITY SERVICES REQUIRED AS A RESULT OF SPECIAL EVENTS HELD IN CITY PARKS AND RECREATION FACILITIES; BY CREATING SECTION 98.23, “AUTHORITY TO CLOSE, VACATE, OR DENY ADDITIONAL ENTRY,” TO PROVIDE AUTHORITY TO CERTAIN CITY PERSONNEL TO CLOSE, VACATE OR DENY ADDITIONAL ENTRY OF PATRONS INTO PARKS AND RECREATIONAL FACILITIES UNDER CERTAIN CIRCUMSTANCES; PROVIDING FOR PENALTIES; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

Summary Explanation/Background:
The amendment is to Chapter 98, Parks and Playgrounds,” to amend Section 98.07, “Public Events,” and create Section 98.23”Authoirty to Close, Vacate, or Deny Additional Entry”. In amending Section 98.07 the City is codifying the collection of compensation for the cost of city services required as a result of a special events held in City Parks and Recreation Facilities with or without a Public Event Permit. In creating Section 98.23, “Authority to Close, Vacate, or Deny Additional Entry,” the city is providing authority to the Broward Sherriff’s Office (BSO), City Manager, Recreation Programs Administrator to regulate an event when occupancy, parking or whenever necessary for the protection of the health, safety, and welfare of park patrons or the surrounding community are at risk.
