Summary Explanation/Background:
The six flex units allocated to the Highland Oaks Townhouse project at 921 NW 3rd Avenue in 2008 were approved prior to the adoption of the City’s in-lieu-fee option for the affordable housing requirements under Chapter 154. The current expiration date of the six flex units has been extended to May 29, 2024 and thus the flex unit allocation is still valid. The Applicant is requesting an amendment to the original flex allocation resolution to allow the buy-out provision to be used to meet the affordable housing requirement for the Highland Oaks project. This Resolution amending Section 5 of Resolution 2008-189 will accomplish that objective.
