Summary Explanation/Background:
Section 151.03 (d) "Structures in Waterways" of the Pompano Beach Code of Ordinances allows for fixed docks and other related structures to be installed within five (5) feet of extended property lines provided the affected property owners enter into an agreement with the City. However, as it currently reads, upon sale of property the new owner is required to either enter into a new agreement with the City or remove the structure. This proposed Code amendment, as recommended by the Marine Advisory Board, will enable these agreements to run with the land and not become null and void should either property owner sell the property.
