Summary Explanation/Background:

The Applicant, John Greene on behalf of the owner, James J Maguire Trust, is requesting the abandonment of a 10-foot-wide Utility Easement that runs through the middle of a property located at 512 SE 28th Avenue. The property lies on the east side of SE 28th Avenue at the terminus of SE 6th Street. The site area currently has a single-family house located on it, which was constructed over the easement. The owner would like to demolish the existing unit and rebuild a single-family unit without being encumbered by the easement. There are no utility assets within the easement. This abandonment request was unanimously recommended for approval at the June 26, 2024 Planning & Zoning Board hearing with 1 condition, that has been met.
