summary

Summary Explanation/Background:

This is a request to terminate a Declaration of Restrictive Covenants for project access. The subject property is located at 1951 N Powerline Rd. In 2010 Waste Management agreed to this a restrictive covenant (see attached) preventing their trucks from accessing Powerline Road.  The covenant was a condition in exchange for not constructing a turn lane on Powerline Road. Now the property has been sold to Bridge Development and they have an approved site plan (see attached D.O. 16-12000065) and Plat Note Amendment to build a Class A Industrial Warehouse/Distribution & Logistics Center. The approved site plan shows the applicant will be constructing the required turn lane (see Attached Paving & Drainage Drawing), and therefore the restrictive covenant is no longer necessary.

Origin of request for this action: Nactaria Chakas, P.A. of Lochrie & Chakas, P.A.

Fiscal impact and source of funding: N/A
