Summary Explanation/Background:

Staff is seeking City Commission approval of a Construction Agreement (see Exhibit A) with the Florida Department of Transportation (FDOT). The agreement is necessary to allow the City to conduct roadway improvements at the intersection of Atlantic Boulevard and NW 6th Avenue (see Location Map). The agreement is also necessary to modify provisions in two other previous agreements (see Exhibits B and C). There are no financial impacts at this time. Financial impacts for work at the aforementioned intersection will be dealt with upon execution of a Guaranteed Maximum Price (GMP) contract with the City’s Construction Manager at Risk (CMAR). Staff reviewed the documentation and found it to be in compliance with similar agreements executed in the past. Staff recommends approval.
