Summary Explanation/Background:
Staff is seeking City Commission approval of an Ordinance to assign an existing contract from Big Span Structures, LLC (prime contractor) to Recreational Design & Construction, Inc. (“Sub Contractor”). The Sub Contractor is a Broward County firm that’s willing and able to assume contract responsibilities as Big Span to help deliver a new roof over the seating areas at The Amp. Big Span was selected by the City of Pompano Beach to lead the project and on March 27, 2019 a City Ordinance No. 2019-36 was enacted approving a contract in the sum of $3,497,974.12 to provide turnkey services. Under the terms of the agreement, and as per Article 10 - Miscellaneous, Big Span is authorized to assign the contract subject to City’s approval. The article states that the Sub Contractor must observe the same terms of the agreement. Although Big Span was unable to secure a required Performance bond, the firm will remain as the designer and supplier for the project. The Sub Contractor will post the bond, instead. Staff has no objections and recommends approval.
