Summary Explanation/Background:
At the March City Commission Meeting, the City Commission requested staff review the Zoning Code related to fences and walls within street-side yards. Based on the discussion, Staff proposes the following amendment to the section entitled “Fences and Walls.” The purpose for these changes are to modify the development standards for perimeter fencing for corner and through lots. Currently, the Zoning Code prohibits a six-foot tall fence within a street side yard. This impacts property owners on corner lots, in particular, where a front yard may not have a fence taller than four feet in height, and their street side yards are additionally restricted. The taller fence (those fences taller than four feet in height) may only be constructed if it is set back 4 feet from the property line. This amendment proposed to allow six-foot-tall fences on corner and through lots within the street side-yard. At the April Meeting of the Planning & Zoning Board, the board unanimously recommended approval of the proposed change to the zoning code.
