Summary Explanation/Background:
The Applicant, Keith, Inc. on behalf of Exit 69, LLC., is requesting the abandonment of a 2-foot wide Utility Easement that is located adjacent to the east side of the NW 27th Avenue right-of-way, just south of NW 34th Place. The Applicant is proposing the construction of three additional 1-story warehouse buildings on the subject property. A Site Plan Development Order Condition to dedicate 2-feet of ROW along NW 27th Avenue per the Broward County Trafficway Plan has necessitated this abandonment request.

As shown in the Review Standard found in, Section 155.2431 D. of the Code (see Attachment I) states that requests for a vacation or abandonment of a public right-of-way or easement shall be approved only on a finding that all of the following standards are met: 1. the right-of-way or easement is not now, or in the foreseeable future, of any benefit to the city or its inhabitants; and 2. the vacation or abandonment of the right-of-way or easement is consistent with the comprehensive plan. Staff has determined that these Review Standards have been met for this request. Therefore, it was unanimously recommended for approval at the July 22, 2020 Planning & Zoning Board hearing with one condition, which has been met.
