Summary Explanation/Background:
The Applicant, Graham Penn, Esq., on behalf of AMP IV - Hidden Harbour, LLC. is requesting the abandonment of portions of two sidewalks included within the Right-of-Way located at NE 23 Avenue; and to abandon two small remnant triangular parcels within the previously abandoned NE 15th Street right-of-way that should have been included with the rest of the street. The Applicant is requesting the NE 23rd Avenue abandonments in order to enable the 'Harborside at Hidden Harbour' project's structural supports and building to be located within the area to be abandoned. The abandoned sidewalks will be replaced with a public access easement to retain the purpose and function of the sidewalks. This abandonment request was recommended for approval at the November 18, 2019 Planning & Zoning Board hearing in a 4 to 3 vote with three conditions, which will be met prior to second reading. Exhibit "B" of the ordinance includes three conditions relating to the relocation of the utilities and requiring a perpetual non-exclusive easement over the area to be vacated.

When the abandonment is placed on a Commission agenda for second reading (currently planned for January 14), the following companion items will also be presented: (1) Second reading of the PD-I rezoning request; (2) Perpetual non-exclusive easement dedication and maintenance agreement for the vacated sidewalks; (3) Air-rights Agreement for the elevated pedestrian bridge; and (4) Unified control document.
