Summary Explanation/Background:
The proposed Resolution will extend and amend the City's Towing and Wrecker Agreement with Emerald. Emerald has been exclusively providing towing services to the City since 2011; since that time Emerald has provided high quality service to the City. Emerald has been responsive and diligent to City requests. Based on the positive feedback from departments who work with Emerald directly, staff is recommending extending the Agreement for an additional 5 years.

In addition to the extension, the method in which Emerald pays the City will need to be amended to comply with State Statute (Chapter 2020-174). The city will no longer be paid a monthly franchise fee. Instead a 25% administrative charge will be applied to the tow rates. The City's tow rates will be updated through a separate Ordinance that will adopt the same rates as Broward County. Based on the new rate structure, it is anticipated the City will annually collect $178K, which is consistent with what the City collected under the previous payment method.

Other sections of the Agreement are amended to define the venue in which any litigated claims will be heard, update language to comply with current public record laws and add language regarding Force Majeure and public safety guidelines.
