Summary Explanation/Background:
In 2015, a case was decided by the Supreme Court of the United States on the topic of noncommercial temporary signs (Reed v Town of Gilbert). The majority opinion from the Justices was that signage should not be regulated based on the content of the message. In 2016, the City hired outside counsel to address the provisions of the City's Sign Code (Chapter 156) that may be in conflict with that determination. The Sign Code was substantially re-written based on recommendations made by outside counsel. The revised Sign Code was adopted in February 2017 (Ordinance 2017-29). Prior to the revisions, Non-Commercial Signs were permitted at a size of 32 square feet in sign area. Upon adoption of the revisions to the Sign Code (Chapter 156), a Sign Code Compliance Permit application was required for all signs not exempt from obtaining a permit and a fee of $25 to process the application. All non-commercial signs were reduced from a maximum sign area of 32 square feet in size to a maximum of 24 square feet in size. In an effort to ensure that all signs (regardless of the content of their message) are treated equally, all temporary signs in nonresidential zoning districts are proposed to be increased to a size of 32 square feet. If approved, this amendment would increase the size area of all temporary signs in nonresidential zoning districts from 24 square feet in size to 32 square feet in size, as well as eliminate the requirement for obtaining a Sign Code Compliance Permit.
