Summary Explanation/Background:
The City's Code of Ordinances currently restrict alcohol sales to the hours of 7 a.m. to 2 a.m. Chapter 110 states that these restrictions apply to organizations authorized under the "state beverage laws" to sell or otherwise distribute alcoholic beverages. The proposed amendment seeks to clarify that any establishment that meets the zoning definition of "alcoholic beverage establishment" is subject to the hours of operation, even if they are exempt from having to obtain a state liquor license from the Division of Alcohol and Tobacco.

There are licensure exemptions offered at the state level, which could potentially allow a business to allow alcohol to be consumed on premise without maintaining a liquor license. Some of these organizations intend to operate in Pompano Beach and offer or allow members of their organization to consume alcoholic beverages on-premise without first receiving a state license. This text amendment is intended to clarify that the restriction on the hours of operation applies to all alcoholic beverage establishments and not simply those businesses required to maintain a license by the state.
