summary

Summary Explanation/Background:

On November 1998, the electors of the State of Florida approved an amendment to the Constitution of the State of Florida authorizing the Legislature of the State of Florida to allow municipalities to grant an additional homestead tax exemption not to exceed $25,000 to any property owner who has attained the age of 65, and the household income does not exceed $20,000 (Adjusted annually by the percent change in the average cost-of-living index determined by the Department of Revenue).  On November 2000, the City Commission of the City of Pompano Beach enacted an ordinance exercising the authority granted by the State of Florida by granting the additional $25,000 to the eligible residents in the City of Pompano Beach.

On November 2006, the electors of the State of Florida approved yet another amendment increasing the maximum additional exemption for eligible low income senior citizens from $25,000 to $50,000. The City Commission of the City of Pompano Beach adopted the ordinance No.2009-06 exercising the authority granted by the State of Florida increasing the additional low income senior exemption to eligible Pompano Beach residents from $25,000 to $50,000.

In 2014, the City Commission of the City of Pompano Beach amended via Ordinance No.2014-66, Chapter 36, “Taxation and Finance,” of the City of Pompano Beach Code of Ordinances, Section 36.090, “Additional Homestead Exemption.” The City Commission granted an additional homestead exemption in the amount of the assessed value of the property for any eligible low income senior citizen in Pompano Beach that has maintained thereon the permanent residence for at least 25 years and their legal or equitable title to real estate with a just value less than $250,000, for the initial year of application.

The purpose of this ordinance is to provide clarification on the implementation of the maximum additional low income senior resident exemption. It is important to reiterate that since 2009, up to a maximum of $50,000 has been implemented to all eligible low income senior citizens on the City’s portion of the tax bill. In addition to the low income senior homestead exemption, since 2014, eligible low income Pompano Beach senior residents have also received the long term residency senior exemption in the amount of the assessed value of the property.

Passage of this ordinance is merely meant to clarify what has been in practice since 2014 and will not impact the level or amount of exemptions already granted by the City of Pompano Beach.
