Summary Explanation/Background:
This is a companion item to an abandonment of portions of SW 11th Street, located west of S. Dixie Highway. A perpetual fire access was conditioned by the Development Services Department so that a clear path for emergency access is maintained from Captiva Cove to the public right-of-way (see attached June 6, 2019 email). The abandonment approval recommendation from the Planning and Zoning Board also included a condition for the provision of a non-exclusive utility easement. The Planning & Zoning Board unanimously recommended approval of the abandonment at the August 22, 2018 Meeting subject to the retention of the fire access and utility easements. The ordinance for the abandonment was approved on first reading of the ordinance by the City Commission at the July 9th, 2019 Meeting. This Resolution includes the fire access and non-exclusive utility easements executed by the recipients of the right-of-way abandonment.
