Summary Explanation/Background:
The Broward County Development Code permits the Board of County Commissioners to approve a Tri-Party Agreement allowing the issuance of building permit on property within the boundaries of a plat prior to recordation of said plat. The attached agreement is an instrument provided by the Broward County Planning and Development Management Division to facilitate this type of mutual agreement between the County, a city and a developer, allowing permit issuance prior to plat recordation for circumstances that would benefit the public (as in this case for affordable housing).

The Marquis Apartment Plat was approved by the Pompano Beach City Commission on July 23, 2019 (see attached Plat Staff Report). This Resolution for the City's approval of a Tri-Party Agreement, allowing permit issuance prior to recordation, is a companion item with the plat that will be necessary to allow the project to meet the grant deadlines for affordable housing. The City of Pompano Beach is one of the property owners/applicants involved in this 100-unit affordable housing project to be located on Dr. Martin Luther King Jr. Blvd. A site plan for the project was approved at the April 24, 2019 Planning and Zoning meeting (see attached D.O. 19-12000001).
