Summary Explanation/Background:

These properties were recently approved for a master plan rezoning and site plans.  When the rezoning was originally submitted it was owned by a single entity.  Subsequent to the Master Plan rezoning approval, the property ownership was divided, and a condition was placed on the development orders to provide a cross access easement, so that each phase maintains access to the public right-of-way (specifically: NW 31st Avenue and W Atlantic Blvd).  The first rendition of the agreement was first recorded at Broward County (Instrument #: 112814107) without including the City as a party to the agreement, and thus it could be amended without the review/ approval of City Staff.  This "First Amendment" to the 31st Avenue Access Easement Agreement included with this Resolution is the first agreement where the City is party to the agreement.  In addition to the agreement copies of the Title Insurance, and certificate of title for the Residences at Palm Aire for the above referenced cross access agreement are included.
