Summary Explanation/Background:

The proposed resolution is a corrective quit claim deed regarding dedicated right-of-way. On April 25, 2006, the City Commission approved Resolution No. 2006-166 (copy attached) accepting the conveyance of property for dedication as right-of-way along NE 4 St, NE 5 St, and NE 1 Ave.  The property owner recently discovered that there was an error in the legal description for the dedicated right-of-way. Where the legal description was intended to read "…THE NORTH 10.00 FEET OF LOTS 1 THROUGH 15…" the legal description was recorded as "…THE NORTH 10.00 FEET OF LOTS 1 THROUGH 16…", thereby dedicating a portion of Lot 16 that was not intended for right-of-way. Bonnie Miskel, Esq. of Dunay, Miskel & Backman, LLP on behalf of the property owner Pompano Station, LLC, is requesting approval of this Resolution accepting a corrective quit claim deed.
